    Competition Terms & Conditions


    1. General Conditions. Participation in this Contest (“the Contest”) is free. NO PURCHASE NECESSARY TO ENTER OR WIN. The Contest is sponsored by Autodesk Development S.a.r.l; Rue du Puits Godet 6, Case Postale 35, CH-2002 Neuchâtel, Switzerland (“Sponsor”). The Contest is governed by the laws of Switzerland, without regard to any conflicts of laws principles. The courts of the Canton of Neuchâtel shall have sole jurisdiction of any dispute regarding the Contest. If you enter the Contest, you agree to abide by the terms of these Official Rules (the “Rules”) and by the decisions of Sponsor, which shall be made in all cases in the sole and absolute discretion of Sponsor and are final and binding on all matters relating to the Contest.
    2. Eligibility. This Contest is open to individuals 18 and over or over the age of majority in their jurisdiction or residence, whichever is older, who are residents of the United Kingdom or Italy (the “Participating Countries”). Entrants who are residents of a country, state, province or jurisdiction that (1) prohibits any aspect of this Contest or (2) prohibits unregistered contests or (3) requires the Contest sponsor to post a bond, are ineligible.  Autodesk expressly disclaims any responsibility or liability for any entrant who enters when it is illegal for them to do so.  Autodesk reserves the right to disqualify any participant if Autodesk suspects, in its sole discretion, that participant did not follow these official rules, or if participant’s participation in the Contest would violate applicable laws of the jurisdiction in which the participant resides. Employees of Autodesk Development S.a.r.l. (“Sponsor”) or of Autodesk, Inc or of any of its subsidiaries, their partners, their suppliers and respective advertising and promotional agencies, members of their household, and their immediate family members are not eligible for this Contest. Sponsor reserves the right to verify eligibility qualifications of winner. Sponsor will only accept entries that have been completed and submitted as described below. Participants may be required to submit proof of their eligibility.  Autodesk reserves the right, in its sole discretion, to determine whether eligibility requirements have been met.
    3. Entry. In the UK, the Contest will run from Wednesday July 21st to Wednesday August 18th, 2010 (the “Contest Period”). In Italy, the contest will run from September 13th to October 11th. Multiple entries per Entrant are permitted. In order to enter the Contest, Entrants shall upload links to their 3D Design Visualisation showreel (via links to their assets on YouTube, Flickr, and web site / blog pages) and submit it via a comment on the following webpage: http://www.autodeskshowcase.co.uk/are-you-a-3d-star-time-to-showcase-your-talent. Entries must include the name of the Entrant. Entries must be submitted electronically and must be received by Wednesday August 18th, 2010 11:59:59 pm GMT for UK and Monday October 11th 2010, 11:59:59 pm CET for Italy (the “End Date”). All entries must have used Autodesk software in their creation – this can be used solely or in conjunction with other Autodesk or other 3rd Party software. Using a trial version of Autodesk software is acceptable as use of Autodesk software. Registering for this event constitutes acknowledgement that you have read and agreed to the terms and conditions of the Contest as described in these Rules and also constitutes acknowledgement that you have read and agreed to the terms and conditions of YouTube and Flickr. Upon submission, all entries become the sole property of Sponsor and will not be returned. Sponsor will have no responsibility for, and will have the right to refuse in its sole and absolute discretion, any entries that have been tampered with, or entries that are misdirected, incomplete, non-conforming, corrupt, lost, late, or ineligible, whether due to Internet or e-mail server failure or otherwise. Sponsor and its affiliates, subsidiaries, divisions, advertising, and promotion agencies are not responsible for incorrect or inaccurate transcription of entry information, human error, or technical malfunctions, related to or resulting from any other error or malfunction; and hereby exclude any liability of the Sponsor and its affiliates, subsidiaries, divisions, advertising, and promotion agencies for any special, incidental, or consequential damages howsoever caused whether in statute, contract, or in tort arising out of this Contest.
    4. Judging. A qualified panel of judges, consisting of Sponsor’s representatives will select winners from among all eligible entries received by the End Date. The judges for the UK will be the following: Graham Bell (Applications Engineer), Robin Oldroyd (Applications Engineer II) and Kevin Booth (Technical Manager M&E Northern Europe). The judges for Italy will be the following: Graham Bell (Applications Engineer), Robin Oldroyd (Applications Engineer II) and Giorgio Giannico (Automotive Solution Engineer) (the “Judges”). All entries will be judged according to the following Judging Criteria: overall design (20%), creative ability (20%), technical ability (20%), aesthetic appeal (20%), number of comment ‘Likes’ (via Disqus blog functionality) (20%). Each vote from an individual will only be counted once. At the Judges’ discretion, entries including unsuitable content or that are in violation of third party rights (including, but not limited to, copyright or trademark rights) will be immediately disqualified. The Judges have the right to disqualify any entry that is not in compliance with these Rules, in the Judges’ sole and absolute discretion. All designs submitted by an Entrant must be the original work of that Entrant. If an Entrant submits a design that is not his or her original work, it is a violation of these Rules and may result in disqualification.
    5. Prizes. The Prize for this Contest consists of the following: six (6) graphic cards i.e. two (2) high-end graphic cards (one (1) per Participating Country) (Cash Value per high-end graphic card: EURO € 1,365) and four (4) mid-range graphic cards (two (2) per Participating Country) (Cash Value per mid-range graphic card: EURO € 285). If the stated prize is unavailable, Sponsor has the right to substitute one or more items of equal or greater value, in its sole and absolute discretion. No prize is exchangeable, transferable, or redeemable for cash. Winners agree to indemnify and hold harmless Autodesk, Inc., its affiliates, subsidiaries, agents, and advertising agencies from and against any/all loss/injury/damages now and in the future as a result of acceptance, use/misuse of any prize and/or participation in this Contest. Sponsor will not replace any lost or stolen Prize.
    6. Winners’ selection; Award of Prizes. The winning Prize entries will be selected from all eligible entries submitted. The Judges will nominate in accordance with the Judging Criteria one Entrant per Participating Country each week during the Contest Period i.e. the Judges will nominate one Entrant for the United Kingdom, and will nominate one Entrant for Italy. Each Entrant can be nominated only once during the Contest Period regardless the number of entries submitted. The shortlist of nominated Entrants will be communicated on Friday 20th August 2010. The Prize winners (“Winner”) will be selected in accordance with the Judging Criteria by the Judges on Wednesday 25th August 2010 and the prizes will be awarded. Winners need not be present to win. Sponsor will notify the Winners by e-mail using the email address submitted with Winner’s entry. Sponsor will attempt to contact Winners twice within seven (7) days of selection. No response received within this time frame may result in disqualification and an alternate winner may be selected. Winners will be solely responsible for complying with any and all applicable federal, state, local, or other statutes, regulations, and other laws and for bearing any personal income or other taxes, fees, insurance, surcharges or other costs relating to any prize. Winners may be required to provide Sponsor with the Winner’s social security or tax payer identification number for tax purposes.
    7. Representations. By entering the Contest, each Entrant represents and warrants that: (a) the Entrant meets all eligibility requirements of the Contest; (b) in entering and participating in the Contest, the Entrant has complied and will comply in all respects with these Rules and all applicable statutes, regulations, and other laws; and © the entry consists entirely of the Entrant’s own original work.
    8. Release. To the maximum extent permitted by law, by entering the Contest, each Entrant releases and holds harmless Sponsor, the prize manufacturers, and any of their related companies and representatives from any and all responsibility or liability (including, without limitation, for any injuries, losses, or damages of any kind, such as compensatory, direct, incidental, consequential, punitive, or other damages) arising out of or relating to: (a) the Contest; (b) claims based on copyright or trademark infringement, or infringement of other intellectual property rights; © the acceptance, possession, receipt, or use of any prize; (d) any entries that have been tampered with or that are misdirected, incomplete, non-conforming, corrupt, lost, late, or ineligible; (e) computer, telephone, cable, satellite, network, hardware, or software malfunctions or failures; garbled or jumbled transmissions; or Internet or website accessibility or delays; (f) printing or typographical errors in any Contest-related materials; or (g) any other technical or human errors occurring in connection with the Contest (the “Causes”). Entrants understand and agree that if anyone makes any claim against Sponsor arising out of or relating to any of the Causes, Entrants will pay for any damages, losses, liabilities, costs, penalties, and expenses, including without limitation attorneys’ and experts’ fees and costs, incurred in connection with such claim. THE PRIZE WILL BE GIVEN AWAY BY SPONSOR “AS IS.” SPONSOR DOES NOT MAKE AND EXPRESSLY DISCLAIMS ANY WARRANTY, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING ANY PRIZE OR PORTION THEREOF, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
    9. Conduct. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest; to be acting in violation of the Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Entries may be disqualified, at the sole discretion of Autodesk Development S.a.r.l. in the event that any attempt is made to subvert the letter and/or spirit of the Rules of this Contest. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY CONSTITUTE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL AND TO THE FULLEST EXTENT PERMITTED BY LAW.
    10. Termination. Decisions and selections made by Sponsor are final and binding with respect to this Contest. Taxes, custom duties, fees and other expenses in connection with the prize are the sole responsibility of the winner. If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or other tampering with this promotion, or technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right to void any suspect entries and/or to modify or terminate this Contest in whole or in part at any time without notice.
    11. Advertising./ Data privacy. To the maximum extent permitted by law, by entering the Contest, each Entrant consents to the use by Sponsor, or any third party chosen by Sponsor, of any and all information related to the Contest, including any personal information obtained through the Contest, for advertising, marketing or other purposes in accordance with Sponsor’s Privacy Policy a copy of which may be downloaded at http://usa.autodesk.com/adsk/servlet/index?siteID=123112&id=786921. To the maximum extent permitted by law, by accepting a prize, Winner consents to the print and online publication of Winner’s name and address as part of a Winners’ List and to the use of Winner’s name, voice, photograph, biographical material, design and likeness by Sponsor or any third party chosen by Sponsor for the purposes of the advertising, and marketing of Autodesk products and services, and related purposes without additional compensation. However Winners acknowledge that there is no guarantee that their photograph, biographical material, design and likeness will be published by Sponsor. Other than as set forth herein, Sponsor will treat any personal information supplied by Entrants in connection with the Contest in accordance with Sponsor’s Privacy Policy.
    12. No Endorsement. Nothing contained herein or in any of the Contest related materials should be construed as an endorsement by Sponsor of the prize manufacturers, or any third party, product, or service.
    13. Winners. The names of the prize winners will be posted on the www.autodeskshowcase.co.uk website on Wednesday 25th August 2010.
